Toms River Addresses Illegal Pool Rentals

  TOMS RIVER – The Township is reminding residents that it’s illegal for property owners to rent out any “amenities” such as pools.

  Now that we are in the midst of summer, some homeowners have been using sites like Swimply.com that allow visitors to book out their pool for several hours or the entire day.

  According to Toms River Municipal Code, this action is illegal and the town will be issuing summonses to those violating the Township Ordinance. The ordinance states how property owners are prohibited from renting any “amenities,” including swimming pools. It is also illegal to advertise, either in print or online, the illegal pool rentals.

  “We have ordinances in place to protect not only the integrity and peacefulness of neighborhoods but the overall health and safety of residents,” Mayor Maurice “Mo” Hill said.

  These public listings will be periodically viewed by the Township’s Code Enforcement Division as well as the Quality-of-Life Unit and they will be handing out summonses to homeowners that violate local codes.

  “In addition to violating the Township Code these rentals illegally convert private swimming pools into public pools in violation of state, local, and Ocean County Health Department regulations. As well as receiving any locally imposed fines, homeowners who violate the

code will be referred to the appropriate state agency for additional enforcement. Additionally, rental of a privately owned pool may compromise their homeowner insurance coverage,” Hill said.
